Truck falls 25 metres from viaduct due to ‘inadequate’ guard rails

Brisa motorway operator has been ordered to pay a former truck driver €258,000 for the permanent injuries he sustained due to inadequate guard rails on a viaduct on the A1.

The accident, which happened nine years ago, saw the driver and his goods van plunge 25 metres.

Finally condemning Brisa this week, Santarém court said the company had “violated rules of protection” and failed in its duty of care.

This duty “undoubtedly includes” ensuring that road safety barriers are strong enough to save vehicles that come in contact with them from breaking through and suffering even further damages, ruled the court.
