Changes to the law governing holiday lets falling under the “Alojamento Local” (local lodging) regime have been introduced.
In its December issue of “UPDATE”, afpop, Portugal’s largest association for foreign residents, explained that property owners who are already holders of an “Alojamento Local” licence, issued before the new legislation was introduced on November 27, 2014, are obliged to present a document from the Finanças stating how they are fiscally conducting the renting business, “whether it is by being registered as sole trader or through a company”.
This document is called ‘Início de Actividade’ and has to be presented at your local Câmara Municipal before December 27 2014. “Failure to present this document could lead to a fine,” afpop told its members.
“In most Câmaras this can be presented by post or e-mail and you must mention your full name, your fiscal number, the address of the property that has the AL licence and the AL licence number. When submitting by post you need to send copies of the original documents.
“If you do not present the ‘Início de Actividade’ before December 27, your licence will not be considered complete and you cannot legally continue to rent the property.”
The ‘Início de Actividade’ document can be re-requested from your local Finanças office, or you can also print a copy from the Finanças website, having logged in with your fiscal number and password and following the steps: Os Seus Serviços /Obter /Comprovativos/ Actividade.
If you have already presented the Inicio de Actividade document with your initial application for the licence, then you will not need to do so again.
